The Cost of a Bad Exit

Firing someone the wrong way isn't just stressful, it's financially dangerous. The Kenyan courts heavily penalize employers who skip procedure. Doing it right the first time is significantly cheaper than losing in court.

Employment FAQs

Do I need written contracts for all employees?
If someone works for you for more than 3 months, Kenyan law requires a written contract. Written terms reduce disputes and protect both sides.
How should I handle a termination?
Follow fair procedure: clear reasons, notice, a hearing where required, and proper documentation. Skipping process often triggers unfair termination claims.
Can employees sue for unfair dismissal?
Yes. Employees can file claims at the Employment and Labour Relations Court. Where procedure or reasons are unfair, the court may award compensation of up to 12 months' salary.
Do you represent both employers and employees?
Yes. We advise employers on compliance and disputes, and we also represent employees and executives in unfair termination, discrimination and benefits disputes.
Can disputes be settled out of court?
Often yes. Negotiation and mediation can be faster, cheaper, and better for reputations than litigation. We frequently draft Mutual Separation Agreements (MSAs) to end employment quietly.
